WALKERS FURNITURE TERMS & CONDITIONS OF SALE
We aim to continuously to develop and improve our website assisting you the customer and to continuously review our products and pricing. The website may involve the following from time to time which may impact upon the service or functionality of the site:
- modify or withdraw items from the site
- amend the terms and conditions of the site
- add or remove special offers or promotions
We have tried to make your browsing and order placing as easy and enjoyable as possible, providing you with the necessary information and guidance. However as colour reproduction depends on your individual computer or laptop, the monitor may not display a definitive colour reflection of the goods displayed.
We have tried to make every effort to ensure that we capture the colour of furniture and swatches as accurately as possible
All of our quoted prices are inclusive of V.A.T. at the prevailing rate; however adjustments will have to be made to comply with any change in rates or other legally imposed charges in respect of V.A.T.
This agreement is a contract for goods and services between us the supplier and you the consumer. At the time Walkers Furniture are in receipt of your order and you the consumer receive the confirmation email, both parties become bound to provide the goods (by us the supplier) and to pay in full and accept delivery of the goods (you the consumer).
1. PURCHASES & PAYMENT
It is important that at the time of placing your order via the website that you ensure all of your order details are correct and they meet your requirements, as once your order has been received and confirmed by email, it may not be possible to amend your order.
We understand that there may be occasions where a customer may have chosen incorrectly, at these times we have applied a discretion fee of £150 which would cover transportation costs within a 45 mile radius to and from the store, admin and reordering costs. Please note that if an error is made by Walkers Furniture no additional costs will be incurred.
No order for goods can be effective and binding on Walkers Furniture unless:
a) You pay in full via the electronic checkout and such payment, if not in cash, has been cleared (in the case of cheques) or authorised (in the case of payments by credit card) or
b) Walkers Furniture allow (at its sole and absolute discretion) goods to be ordered without the payment of any deposit or
c) Where you seek to purchase the goods on extended credit, your credit application is approved via the store.
2. When the required deposit is paid or the payment of the deposit (if not cash) is cleared or authorised (as set out in clause 1(a) above), you will be legally bound to proceed with the purchase of the goods you have ordered and you will be liable to pay Walkers Furniture the balance (the Balance Due figure provided at the time of placing the order via the electronic checkout) at the time that sum is due for payment. The time any sum is due for payment is set out in clause 4 below. This clause does not apply to purchases on extended credit.
3. If Walkers Furniture allow you to order the goods without payment of a deposit (as in 1(b) above you will be legally bound to proceed with the purchase of the goods you have ordered electronically via the website, upon which you will receive confirmation of your order via the website and you will be liable to pay Walkers Furniture the full purchase price (the TOTAL figure documented on your confirmation order) when that sum is due for payment. The time any sum is due for payment is set out in clause 4 below. This clause does not apply to purchases on extended credit.
4. TIME FOR PAYMENT (NOT APPLICABLE TO EXTENDED CREDIT)
The purchase price or, if a deposit has been paid, the balance, must be paid prior to delivery, fitting or collection. If you require the goods to be stored, the purchase price or balance is payable within seven days of us notifying you that the goods are available and the sum due must be paid by you within this time, without any further reminder from Walkers Furniture. In all other cases Walkers Furniture will notify you of the time by or at which you have to pay any such sum due to them and this must be paid to Walkers Furniture by or at the time stated. This clause applies to purchases under clause 2 and 3 above but does not apply to purchases on extended credit.
5. EXTENDED CREDIT
If you apply to purchase the goods on extended credit, you will be legally bound to proceed with the purchase of the goods once your credit application has been approved via the store. If, after your credit application has been approved, you then seek to cancel your order and/ or do not wish to or refuse to accept or collect the goods, you will (unless Walkers Furniture has agreed to a cancellation as set out in the clause headed Cancellations below) personally be liable to pay Walkers Furniture the full purchase price (the TOTAL figure documented on your confirmation order) or if applicable, any balance outstanding on the purchase price. In the event that you cancel your order without Walkers Furniture agreement or fail or refuse to accept the goods, Walkers Furniture will notify you of the time by or at which you have to pay any such sum due to them and this must be paid to Walkers Furniture by or at the time stated, even if you do not intend to accept or collect the goods.
6. If you do not pay the purchase price or any balance outstanding on the purchase price at the time it is due, Walkers Furniture have the right to recover such price or balance outstanding on the price from you by legal proceedings. For the avoidance of doubt, this clause applies to sums due under clause 4 and 5 above and applies:
i) even if you cancel your order (subject to the clause headed Cancellations below) and/ or you do not intend to accept or collect the goods you have ordered.
ii) whether or not the property in the goods has passed to you.
EXTENDED STORAGE
If you are unable to take delivery within seven days of the goods becoming available and they are PAID IN FULL, we reserve the right to apply a storage charge fee thereafter due to limited space available.
EXTENDED CREDIT
All applications for credit will be processed as quickly as possible, however no goods paid for in this way can be delivered, supplied or ordered from our suppliers until credit approval has been received.
DISTANCE SELLING CANCELLATIONS & RETURNS
Even if you are bound by this agreement to proceed with the purchase of the goods and/ or pay Walkers Furniture the purchase price or whatever balance is due under this agreement, Walkers Furniture may, as its sole and absolute discretion and in such circumstances as it sees fit, agree to you cancelling your order. If Walkers Furniture agrees to such a cancellation, this will only be on terms that you agree to pay a sum representing a genuine and reasonable estimate of Walkers Furniture losses and costs that have been and/ or will be incurred as a result of and incidental to your cancellation.
Please note that cancellations cannot be accepted in respect of goods ordered from stock or specially ordered for you.
Should an instance arise where we are unable to supply the goods you have ordered, you may cancel your agreement without any charge and will be reimbursed fully.
The terms of this agreement do not affect your statutory rights in connection with the goods or such rights as you may have under any relevant legislation (e.g. the Consumer Credit Act 1974) to withdraw or cancel an order without any obligation to pay.
Should you wish to return your goods, it is your responsibility to take the necessary care of the goods within your care. You are now the owner once you have taken these into your possession and you are liable for any loss or damage, therefore they must be unused, from within a domestic environment and encountered no abuse from children, pets or any other source. Failure to take reasonable care may result in a claim against you. To minimise the risk of any such action, please retain the original packaging and use when returning the goods.
CANCELLING GOODS AVAILABLE FOR DELIVERY WITHIN 2 WEEKS FROM ORDER BEING PLACED:
You must contact the store to cancel you order either by email, writing (received by) or telephone up to and including seven working days following Walkers Furniture taking receipt of your delivery and request, Walkers Furniture will arrange to have the goods to be collected and will reimburse your costs.
Please note that if you have specifically requested goods to be supplied using the Design your Own method and/ or any other made to order goods, not taken from stock, this must be done within seven days of placing your order and you may incur a cancellation fee due to materials being ordered to meet your order, after this date unfortunately we cannot accept a cancellation.
Should you decide to return the goods or cancel your order within one week of taking delivery you have a statutory duty to take care of them and ensure they are undamaged, unused and appropriately packaged.
If you decide to cancel your order after taking delivery of the goods we will arrange to collect up to and including the 45 mile radius of the store for a small collection fee of £50, original postage costs will NOT be reimbursed.
FOR GOODS AVAILABLE FOR DELIVERY AFTER 2 WEEKS FROM ORDER BEING PLACED:
These goods are made to order and you have no statutory right to return them unless they have a defect.
Should we agree to cancel your agreement and your goods are available for delivery after the two weeks from the time your order was confirmed by email, you agree to pay a standard fee which is a percentage of the total order value.
DELIVERY DATES
All dates quoted at the time of sale are made in good faith and whilst we always make every effort to honour them, it must be recognised that they are estimated lead times only and consequently we cannot accept any liability or damage claims resulting from delayed deliveries, which are less than five weeks overdue.
If we can get your order despatched before the approximate lead time we will do so.
When we receive your furniture we will contact you to inform you either via email or telephone to then arrange a mutually convenient delivery day. Please note that currently we do not deliver at weekends.
DELIVERY ARRANGEMENTS
Walkers Furniture offers a stress free delivery service to you the customer. Experienced employees will deliver your goods into your home/ or designated delivery address using our own vehicles, completing the installation of your ordered goods into your chosen room.
We deliver within a 45 mile radius from the store, however should your delivery area exceed the 45 mile radius but remains within the UK mainland, we can assist you in making arrangements with an external company carrier or you can arrange these personally liaising with the store. A quotation would be provided via the store if requested.
Please note that external couriers arranged for this service may not be guaranteed to deliver to within your home and we cannot be held responsible for any damage caused to your home or the goods supplied.
Should your order become delayed which are beyond our control, we will make every effort to keep you informed of any revised delivery schedules.
It is important that you must take delivery of your goods seven days after they become available. You may be asked to sign a disclaimer once the installation is completed.
DELIVERY ACCESS
It is important that you are responsible for providing adequate access to your property and the area to which it is to be placed is suitably cleared to enable delivery of goods in a safe manner. We cannot accept any liability for damage to property resulting from inadequate or difficult access. We accept no responsibility for any other damage caused to the property during delivery.
Our delivery team will unwrap your goods (unless self build where an additional charge would be applied and agreed at the time of order if the goods are to be built up within your home), install it in the room of your choice (when delivered within the 45 mile radius by Walkers Furniture employees) and remove packaging and recycle wherever possible.
Unfortunately we cannot take your old furniture away, but if necessary we can arrange for this to be lifted if adquate access is available, and placed outside of your own home; once again we cannot accept any liability for damage to property resulting from inadequate or difficult access removing the said goods. Please inform staff when the delivery date is being scheduled that this service is required.
To ensure you are completely satisfied with your goods the delivery team will ask you to sign and confirm you are happy with goods after they have been installed.
DELIVERY DAMAGE
You must inspect all goods on delivery and report any damage or shortage of delivery at once. Should this be impractical because of packaging etc, notification must be made within three days of delivery. Failure to do so may affect your rights to reject the goods. Your statutory rights are unaffected by this condition.
COLOURS & FINISHES
Whilst every effort will be made to match colours and finishes, all natural and synthetic colours and finishes can only be supplied on the understanding that there is always a possibility of variation; also see introduction.
GUARANTEES
All items are under the manufacturers guaranteed of one year, which excludes normal wear and tear and all covering fabrics, leathers and fillings, this means that should any structural component fail during normal use and excludes non-domestic use, this will be repaired free of charge but will exclude if used from within non domestic use, abused from children, pets or any other source.
Should the furniture exceed the 45 mile radius, it may be suggested that the defect model is fully replaced rather than repaired. If the goods location exceed the 45 mile radius it will be your responsibility to return the faulted item(s) to the store where we will do our utmost to get your replacement goods out to you in a timely manner. Our Customer Services department will liaise with you to ensure there are no delays with your replaced goods within our control.
EXCHANGES
All furniture items sold on the internet by Walkers Furniture are made to your order, specifically aimed at upholstery furniture, these items are not taken from stock and are made to your individual specification therefore we are unable to offer an exchange for these items. However if they exclude any made to order goods, and your expression is notified to the store within three days of taking delivery, we will arrange for you to reselect onto a another model or the same or higher value, there will be an administrative and delivery charges applied. Please note the goods must be unused, from within a domestic environment and received no abuse from children, pets or any other source.
SERVICE DETAILS
At Walkers Furniture discretion, a call-out service charge will be made should a problem arise when furniture is deemed out of a manufacturer?s warranty within a 45 mile radius of the store. Walkers Furniture reserves the right to charge you for administration time and for the fees of an upholsterer or other expert.
Damage?. it is important that each item be carefully and thoroughly inspected by you and your Authorised Agent immediately upon delivery. In the event of damage or defect, please notify the delivery person. If this can be corrected by the delivery personnel, it will be taken care of immediately. If not, you must notify the store within three days from taking receipt, upon approval from our Customer Service Department, the item(s) will be repaired or if this cannot be successfully and suitably rectified the item(s) will be replaced, at our discretion and then re-delivered to you. You will not be charged for re-delivery because re-delivery is expensive, please return only the individual item that is unacceptable and not any companion pieces.
You may fully expect that we will handle returns professionally and on a priority basis. To give your returned item the care and attention it requires, please allow both our Customer Service and Quality Control Departments adequate time to evaluate the problem. We are available to keep you apprised of the status of your order and estimated time of return.
DAMAGE TO YOUR COMPUTER
Where Walkers Furniture will make every effort to ensure that the website is free from viruses or defects, however due to the nature of the Internet, we are unable to guarantee that your use of this website will not affect your computer. It would be recommend that you purchase the necessary anti-virus and firewall protection software for your computer which would aid the prevention of any corruption/ damage to your computer from accessing the website. Walkers Furniture shall not be liable in the unlikely event that you incur any damages or loss.
